Welcome to GoHarder. These Terms of Service ("Terms") govern your use of the GoHarder mobile application and web platform (collectively, the "Service"). By using our Service, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

You must be at least 13 years old (or 16 in the EU) to use this Service. By using the Service, you represent that you meet this age requirement.

2. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You may not share your account or use another person's account
  • We reserve the right to suspend or terminate accounts that violate these Terms

3. User Types and Roles

3.1 Athletes

Athletes use the mobile app to track workouts, log exercises, and monitor progress. Athletes may connect with trainers to receive personalized programs and coaching.

3.2 Trainers

Trainers use the web platform to manage athletes, create workout programs, and track client progress. Trainers are responsible for the accuracy and safety of programs they create and assign.

4. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Harass, abuse, or harm other users
  • Share inappropriate, offensive, or harmful content
  • Impersonate another person or entity
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Scrape, crawl, or use automated means to access the Service
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Service to send spam or unsolicited communications

5. User Content

You retain ownership of content you create (workout data, photos, messages). By using the Service, you grant us a license to store, display, and process your content as necessary to provide the Service.

You are responsible for ensuring you have the right to share any content you upload. We may remove content that violates these Terms or applicable laws.

6. Health and Safety Disclaimer

IMPORTANT: GoHarder is a workout tracking tool, not medical advice.

  • Consult a healthcare professional before starting any exercise program
  • We are not responsible for injuries resulting from workouts logged or suggested in the app
  • Trainer programs are suggestions; athletes are responsible for their own safety
  • Stop exercising immediately if you experience pain, dizziness, or discomfort
  • The app does not replace professional medical, fitness, or nutritional advice

7. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned byGoHarder and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

8. Third-Party Services

Our Service integrates with third-party services (e.g., Firebase, Apple Health, Google Fit). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Subscription and Payments

Certain features may require a paid subscription. Payment terms:

  • Subscriptions auto-renew unless cancelled before the renewal date
  • Prices may change with notice; existing subscriptions continue at the current rate until renewal
  • Refunds are handled according to Apple App Store and Google Play Store policies
  • We reserve the right to modify or discontinue features with reasonable notice

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" without warranties of any kind
  • We do not guarantee the Service will be uninterrupted, secure, or error-free
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for the Service in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless GoHarder from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights.

12. Termination

  • You may delete your account at any time through the app settings
  • We may suspend or terminate your account for violations of these Terms
  • Upon termination, your right to use the Service ends immediately
  • Data deletion follows our Privacy Policy retention schedule

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Barcelona, Spain, unless otherwise required by applicable consumer protection laws.
